Learned advocate appearing for the petitioner submits that the petitioner was arrested on 15.01.2025 and since then he is in custody. The investigation of the case has already been concluded, charges have been framed, as such according to the petitioner further detention is unwarranted and so on any stringent condition he may be released on bail.

Mr. Biswas, learned advocate appearing for the State submits that 449 bottles of phensedyl were recovered from the possession of the petitioner and there are overwhelming materials available with the prosecution to prove the case.

I have considered the case diary and I find that the independent witnesses of the seizure list are cited as CSW 5 and 6.

In view of the next date fixed on 17.07.2025 by the learned Special Court for evidence I direct the learned Special Court to conclude the evidence of CSW 5 and 6 preferably by 08.08.2025.

Petitioner would be at liberty to renew the prayer for bail after the evidence of CSW 5 and 6 is over. At this stage the prayer for bail of the petitioner in CRM (NDPS) 189 of 2025 is rejected.
