Kausik Calcutta High Court In the Circuit Bench at Jalpaiguri CRM (NDPS) 191 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kotwali Police Station Case No. 83 of 2025 dated 27.01.2025 under Section 20(b)(ii)(B)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is in custody since 27.01.2025 and the contraband so seized are of intermediate quantity. It is further submitted that since the charge sheet has already been submitted further detention of the petitioner may not be warranted for the sake of investigation. Learned advocate for the State opposes the prayer for bail and submits that one of the accused person is still

absconding, as such the prayer for bail of the petitioner should be rejected.

I have considered the submissions of the learned advocate for the petitioner as well as for the State. Having regard to the period of detention and the fact that the seizure so effected in connection with the instant case is of intermediate quantity, I am of the view that the petitioner should be released on bail.

Accordingly, petitioner should furnish bond of Rs. 20,000/- (Rupees twenty thousand only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Special Court. If on bail the petitioner shall make himself available on each and every date so fixed by the trial court.

In case there is any violation of the provisions imposed, the learned trial court would be at liberty to cancel the bail without further referring the petitioner to the High Court.

Accordingly, CRM (NDPS) 191 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
