Kausik Calcutta High Court In the Circuit Bench at Jalpaiguri CRM (NDPS) 192 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 corresponding to Section 439 of the Code of Criminal Procedure, 1973 in connection with New Jalpaiguri Police Station Case No. 1085 of 2024 dated 23.10.2024 under Sections 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that petitioner is in custody for about 259 days and the investigating agency has already concluded the investigation. Consequently, further detention of the petitioner is unwarranted and as such he may be released on bail. On the other hand learned advocate for the State submits that the recoveries so made from the petitioner are of commercial quantity of contraband. Further the Hon'ble High Court has been pleased to reject the prayer
for bail of the petitioner in CRM (NDPS) 27 of 2025. It has also been pointed out that the next date has been fixed in the month of July for supply of copies.
Learned Trial Court as such is directed to ensure that the copies are supplied to the accused and steps are taken expeditiously for consideration of charges within a reasonable period of time.
As there has been no change of circumstances since the prayer for bail of the petitioner was rejected lastly, I am of the view that at this stage the prayer so advanced cannot be accepted.
Consequently, CRM (NDPS) 192 of 2025 is rejected.
