Affidavit of service and the supplementary affidavit filed by the petitioner are taken on record. The petitioner has prayed for a direction upon the competent authority to consider the representation submitted by her before the authority on 20th December, 2019.
Petitioner's husband, since deceased, was an Assistant Teacher of New Additional Primary School under Kalchini Circle, Alipurduar. Petitioner being the legal heir of her husband, has claimed retiral benefits of her husband before the authority. Petitioner prays for a direction upon the authority to consider the representation at the earliest.
Upon consideration of the submissions made on behalf of the parties and material on record, the writ petition is disposed of directing the 5th respondent to consider and dispose of the representation submitted by the petitioner dated 20th December, 2019 within
four weeks from the date of communication of this order after affording reasonable opportunity of hearing to the petitioner, in accordance with law.
With the above directions, WPA 1313 of 2020 is disposed of. However, there shall be no order as to costs. The decision taken by the authority shall be communicated to the petitioner within a week thereof. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
