rkd 25.11.2019 Ct. No.28 C.R.M. 10971 of 2019 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 21/11/2019 in connection with Alipurduar P.S. Case No. 118 of 2018 dated 18/03/2018 under Sections 20(b)(ii)(c) of the NDPS Act and under Sections 379/411/413/414 of the Indian Penal Code.

And In the matter of: - Nitai Barman @ Rahul & Anr. ....petitioners.

Mr. A. Banerjee ...for the petitioners.

Mr. B. Panda, Ms. P. Saha ...for the State.

We have considered the materials on record and bearing in mind the prima facie 24.7 kg. of ganja which is above commercial quantity and in the light of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioners.

The application for bail is, thus, rejected.

Trial court is, however, directed to conclude the trial as expeditiously as possible preferably within one year from the next date fixed before the trial court for recording evidence without granting unnecessary adjournment to either of the parties.
