And In the matter of: Manoj Singh ......Petitioner Mr. Jaydeep Kanta Bhowmik, Advocate Ms. Ankita Patodia, Advocate ....For the Petitioner This criminal revision is filed by one of the three accused persons in Bhaktinagar P.S. Case No. 101 of 2019 dated 07.02.2019 under Section 22(c) of Narcotic Drugs and Psychotropic Substances Act, challenging an order dated October 30, 2019 passed by the learned Judge, Special Court. By the said order the learned Judge extended the period of investigation by sixty days on and from 04.10.2019. Appearing for the applicant, learned Advocate submits that the order was passed on a petition put up on behalf of the prosecution on October 30, 2019 itself and a copy of the petition was served on the learned Advocate for the applicant at 12.15 p.m..

The learned Advocate was not in a position to make effective submission after obtaining instruction from his client. He had prayed for adjournment but such prayer was rejected and the time to complete investigation was extended as aforesaid. He submits that had such time not been extended, the applicant would have been entitled to statutory bail and would have been out of custody.

I have heard learned Counsel for the prosecution also. The order dated October 30, 2019 has worked itself out. The period of extension is over. The chargesheet has been filed, I am told.

In such circumstances, this application has become infructuous and no order can be passed thereon. However, I request the learned trial Judge to expedite the trial in NDPS case no. 04 of 2019 and bring the trial to its logical conclusion as early as possible and preferably within a period of six months from date.

The CRR 126 of 2020 is accordingly disposed of. (Arijit Banerjee, J)
