CRM (NDPS) 204 of 2025 In re : An Application for Bail under Section 483 of the BNSS, 2023 in connection with NDPS Case No. 24 of 2024 arising out of Sitalkuchi P.S. Case No. 136 of 2024 dated 28.03.2024 under sections 20(b)(ii)(c) NDPS Act, 1985.

Petitioner(s) Mr. Arunava Pal ... for the petitioner(s) Mr. Nilay Chakraborty Mr. Dhimal Sil ... for the State Learned advocate for the petitioner submits that the petitioner is in custody since 28th March, 2024 and, according to the prosecution's case only about 27.080 kg of contraband/ganja were seized from the possession of the petitioner. Learned advocate submits that the investigation of the case has already been completed and charges have already been framed, as such, the petitioner may be released on bail on any stringent condition.

Learned advocate for the State opposes the prayer for bail and submits that evidence has already commenced

in connection with the instant case and the prosecution has relied upon 14 vital witnesses to prove its case. I have considered the submissions advanced by the learned advocate for the petitioner as also that of the State. Having regard to the fact that some of the witnesses have been examined and the majority of the witnesses are yet to be examined by the prosecution, I am of the view that on stringent conditions the prayer for bail of the petitioner is to be considered.

Accordingly the prayer for bail of the petitioner is Allowed with conditions that the petitioner would furnish bond to the satisfaction of the learned Special Court with one local surety. It is categorically stated that the local surety must be a person who would furnish title deed of a property. The petitioner would also make himself physically available on each and every date of the trial so fixed by the learned trial court and shall cooperate with the learned trial court in progress of the trial of the case.

In case there is any violation of the aforementioned conditions, the learned Special Court would cancel the bail without further reference to this Court.

Accordingly, CRM(NDPS) 204 of 2025 is disposed of. Pending application(s), if any, is also disposed of.
