APP Mr. Tapan Bhattacharjee ... for the State Learned advocate for the petitioners submits that the petitioners were arrested on 9th March, 2025 and since then they are in custody. Learned advocate emphasizes on the locus of the petitioner no.2, as it is claimed that the tenor of the prosecution's case is that from the house of the petitioner no.1 seizures were effected. However, there are no materials to substantiate the recovery of the contraband so far as the petitioner no.2 is concerned, as such, he may be released on bail.

Mr. Chakraborty, learned advocate appearing on behalf of the State submits that investigation of the case is still in progress. FSL report has already been received. However, the police authorities are working on certain issues before submitting the report in Final Form before the jurisdictional Special Court.

Having considered the materials which are available in the Case Diary, at this stage, I am not inclined to enlarge the petitioner on bail.

Accordingly, the prayer for bail of the petitioner is Rejected.

However, the petitioners would be at liberty to renew their prayer for bail after submission of the chargesheet/report in Final Form Accordingly, CRM(NDPS) 205 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
