The contempt application arises out of an order passed by an erstwhile Judge, who has since been transferred.

2. It appears that the appeal filed by the petitioner was not in form. Thus, the petitioner's papers were returned with an indication that the petitioner should approach the appellate forum through online mode by filing an online application.

3. It is submitted that the petitioner could not file such online application. In any event, the petitioner shall file a physical copy of the appeal with all his submissions and supporting documents before the Commissioner of Income Tax, Siliguri within a month. If such appeal is filed, same shall be disposed of in accordance

with law and without insisting upon the petitioner to file the appeal online. A reasoned order shall be passed and communicated to the petitioner within a period of three months from the date of receipt of the appeal petition. No personal hearing is required to be given.

4. Accordingly, the contempt application is disposed of. Contempt proceedings are dropped.

5. Parties are to act on the basis of the server copy of this order.
