Mr. Bhowmik, learned advocate appears on behalf of applicant seeking anticipatory bail in connection with Haldibari Police Station Case no.144 of 2019 dated 27.07.2019 under sections 411/414 of Indian Penal Code. He submits, his client only arranged taxi, the driver of which and the hirer were apprehended and arrested. The driver has since found bail. There was no recovery from his client. Mr. Ganguly, learned advocate appears on behalf of State and hands up the case diary, drawing attention to, inter alia, statement made under section 161 in Code of Criminal Procedure of the driver, co-accused. We have considered materials in the case diary as well as order dated 11th September, 2019, by which co-accused / driver was enlarged on bail.

We are inclined to and do grant anticipatory bail. Applicant, in event of arrest, shall be released on anticipatory bail by furnishing bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of 5,000/- (Rupees Five Thousand) each, one of whom must be local, having

landed property, to the satisfaction of Arresting Officer and shall be subject to the condition, as in section 438(2) of the Code of Criminal Procedure and on further condition that applicant shall surrender before the Court below and obtain regular bail within a fortnight from date of this order.

Criminal miscellaneous application, C. R. M. 1081 of 2019, is disposed of.
