Petitioner(s) Mr. Subham Ghosh Mr. Mayank Roy ... for the petitioner(s) Mr. Kallol ACharjee Mr. Dhimal Sil ... for the State Learned advocate for the petitioners submits that from the joint possession of both the petitioners 27 kg of ganja/contraband were allegedly seized and both of them are in custody since 9th September, 2024.

Additionally, it has been submitted that since the investigation has already been concluded and the petitioners substantially are detained, they may be released on bail on any stringent conditions.

Learned advocate for the State opposes the prayer for bail and submits that charge-sheet has already been submitted along with the FSL Report which confirms regarding the contraband being in custody of the petitioners. Be that as it may, having regard to the period of detention of the petitioners, I am inclined to the release the petitioners on bail on stringent conditions.

Accordingly the prayer for bail of the petitioners is Allowed with conditions that the petitioners would furnish bond to the satisfaction of the learned Special Court with one local surety. It is categorically stated that the local surety must be a person who would furnish title deed of a property. The petitioners would also make themselves physically available on each and every date of the trial so fixed by the learned trial court and shall cooperate with the trial court in progress of the trial of the case. In case there is any violation of the aforementioned conditions, the learned Special Court would cancel the bail without further reference to this Court.

Accordingly, CRM(NDPS) 206 of 2025 is disposed of. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
