The respondents remain unrepresented though the petitioner is present in the first as also in the second call. The matter is, therefore, taken up for consideration.
It appears that the petitioner has made several representations to the learned District Magistrate, Kalimpong, being the respondent no.6 in this writ petition. Records reveal that the Commissioner, Jalpaiguri Division, Jalpaiguri being the respondent no.5 on having received a representation from the petitioner through his Advocate had forwarded the same vide a memo dated 1st April, 2024 bearing no.530/LA to the General Manager, NHIDCL, PMU Kalimpong. The petitioner says that none of the representations have been disposed of.
Since the petitioner's representation is required to be brought to a logical conclusion, I direct the respondent no.7 to consider the petitioner's representation dated 20th March, 2024 within a period of eight weeks from the date of communication of a server copy of this order without insisting upon production of a certified copy thereof and dispose of the same by a reasoned order after affording the petitioner a reasonable opportunity of hearing. The reasoned order shall be communicated to the petitioner immediately after the same being passed. The respondent no.7 shall decide all issues raised independently and without being influenced by any observation made in this order.
I make it clear that I have not gone into the merits of the matter.
The petitioner will be entitled to assail the reasoned order and seek relief which has been prayed in this writ petition but is not considered as the representation is directed to be considered. Nothing further remains to be adjudicated in this writ petition.
The writ petition being WPA 1035 of 2024 is, accordingly, disposed of.
