Mr. Saha Poddar, learned Counsel, appears and submits. The State is represented by Mr. Sourav Ganguly, learned Counsel assisted by Ms. Namrata Das, learned Advocate. The petitioners submit that the case relates to a post-poll violence incident, which is now being investigated by the Central Bureau of Investigation (CBI).

Accordingly, leave is sought for from this Court to implead the CBI as a party-Respondent.

The State submits that it is no longer in charge of the investigation and the CBI be directed to independently respond to the petitioners.

After hearing the parties, this Court is of the view that the interests of justice shall be best served in the event the petitioners are permitted to withdraw this application and also granted the liberty to file a fresh application impleading the necessary parties.

Therefore, leave as sought for by the petitioners to withdraw this application, stands granted.

Liberty to file afresh.

CRM 832 of 2021 stands dismissed as not pressed. All parties shall act on the server copy of this order, duly obtained from the official website of the Hon'ble High Court Calcutta.
