Majahar Ali v. State Of West Bengal
27.11.2019 ss Rejected C.R.M. 11066 of 2019 In the matter of : An application for bail under section 439 of the Code of Criminal Procedure filed on 25.11.2019 in connection with Malbazar P.S. Case No.
of dated 29.08.2019 under sections 341/376(3)/376/511/506/34 of the Indian Penal Code and section 4 of the Protection of Children from Sexual Offences Act. And In the matter of : Majahar Ali Mr. Pronojit Roy ... ... for the petitioner Mr. Partha Pratim Sarkar, Mr. Sudip Guha ... ... for the State It is submitted on behalf of the petitioner that he is in custody for 88 days and has been falsely implicated in the instant case. Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner had ravished a minor victim. Having considered the materials on record prima facie disclosing involvement of the petitioner in ravishing a minor, we are of the opinion this is not a fit case to grant bail to the petitioner. The application for bail is, thus, rejected.
