Charge-sheet No. 109 of 2021 dated 29/04/2021 under Section 6 of the POCSO Act, 2012 read with Sections 376(2)(n)/506 of the Indian Penal Code.

And In the matter of: - Sukumar Roy ....petitioner.

Ms. Jeenia Rudra ...for the petitioner.

Mr. Nilay Chakraborty, Mr. Biswarup Roy ...for the State (through V.C.).

The petitioner renews his prayer for bail which was rejected by a co-ordinate Bench by an order dated June 11, 2021 passed in C.R.M. 627 of 2021.

The allegation is under Section 4 of the Protection of Children from Sexual Offences Act, 2012 read with Sections 376/506 of the Indian Penal Code.

Learned Counsel for the State opposes the prayer for bail. We have seen the material on record including the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure.

In view of the recent rejection of the petitioner's prayer and also in view of the material on record, we are not inclined to allow the petitioner's prayer for bail.

Accordingly, the application for bail being C.R.M. 841 of 2021 is dismissed.

However, we request the learned Court below to expedite the consideration of charges to the extent possible. All parties shall act in terms of server copy of this order downloaded from the official website of this Court. (Suvra Ghosh, J.) (Arijit Banerjee, J.)
