Petitioner contends he has been falsely implicated. Co-accused have been granted anticipatory bail. He prays for similar relief.

Learned lawyer for the State opposes the prayer for anticipatory bail.

We have considered the material on record including the statement of injured. He stated petitioner had assaulted him resulting in fracture of both his legs. He was hospitalized.

In view of the aforesaid materials on record we are of the opinion petitioner does not stand on the same footing with co-accused who have been granted anticipatory bail and his prayer for anticipatory bail is rejected. (Ajay Kumar Gupta, J.) (Joymalya Bagchi, J.)
