1. Petitioner is an Indian citizen. He contends he has been falsely implicated on the statement of co-accused. Accordingly, he prays for anticipatory bail.
2. Learned Advocate for the State opposes the prayer for anticipatory bail. He submits petitioner was assisting Bangladeshis to cross the international border.
3. We have considered the materials on record. Petitioner is an Indian citizen. His complicity has transpired from statement of co-accused before police officer. Bangladeshi nationals have already been arrested. Investigation is complete.
4. In view of the aforesaid facts and the extent of complicity of the petitioner in the crime, we are inclined to grant anticipatory bail to the petitioner.
5. Accordingly, we direct that in the event of arrest the petitioner viz., Dindayal Roy shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall appear before the trial court and pray for regular bail within a period of four weeks from date.
6. This application for anticipatory bail is, thus, disposed of.
