The petitioner has filed the present application for not taking appropriate steps on the complaint made by the petitioner.

Ms. Bedashruti Bose, learned counsel appearing for the State has handed over the report submitted by the Assistant Commissioner of Police, Siliguri Metropolitan Police, East Division-1 dated 23rd May, 2024 forwarded by the Commissioner of Police of Siliguri Police Commissionerate wherein it reveals that on receipt of the complaint dated 20th May, 2024, police of Bhaktinagar P.S. Case No. 440 of dated 20.05.2024 under Sections

380/363/365/34 IPC was registered and investigation was started. During investigation the minor was recovered and produced before the Child Welfare Committee, Jalpaiguri on 23rd May, 2024 and shall be produced before the learned Court of Chief Judicial Magistrate, Jalpaiguri on 24th May, 2024. Copy of the said report has also been served upon the learned counsel for the petitioner.

After going through the report submitted by the Commissioner of Police, Siliguri Police Commissionerate, the petitioner has submitted that he is satisfied with the report. The grievance of the petitioner has been taken care of and the minor has been recovered and he will take appropriate steps for taking the custody of the minor from the appropriate Court of law.

The report submitted by the Commissioner of Police, Siliguri Police Commissionerate be kept with the record.

In view of the submission made by the counsel for the petitioner and considering the report submitted by the Commissioner of Police, this Court finds that no purpose would be served by keeping the writ petition pending.

Accordingly, WPA No. 1052 of 2024 is disposed of.
