1. The petitioner is an RPF personnel. She reported for duty at Alipurduar Junction Division on April 26, 2012. By an office order dated April 30, 2012, the petitioner was transferred from Alipurduar Junction Division to Hasimara. On April 10, 2018, the petitioner was transferred from Hasimara to PCoy/ Alipurduar Junction Division. On September 3, 2018, the petitioner was again transferred to RPF/Post-APDJ (P) and the petitioner reported on September 4, 2018. Thereafter, the petitioner was again transferred to Kaihar Division.

2. The petitioner made a prayer for her transfer to Hasimara on the ground that her spouse was an assistant teacher at Hasimara. Such prayer was

made on June 4, 2023. It is contended that the family condition of the petitioner and the factum of her spouse being at Hasimara were relevant considerations for such prayer for transfer.

3. The said application was kept pending. The matter was heard on June 12, 2024 when the learned DSGI submitted that the matter could be resolved upon the petitioner's cooperation. The matter has been listed today, as it is informed that the petitioner had approached the authority in the interregnum.

4. The learned DSGI submits that the prayer of the petitioner for transfer to Hasimara cannot be allowed, but the petitioner had been given options to choose any station within Alipurduar Junction Division. It is informed that the petitioner is ready to cooperate.

5. Accordingly, the writ petition is disposed of with a liberty to the petitioner to give her choice from those stations within Alipurduar Junction Division, which the authorities had indicated to her and the entire issue shall be disposed of upon the petitioner exercising such option within a period of four weeks from the petitioner approaching the appropriate authority, namely, I.G. cum Principal Chief Security Commissioner, Northern Frontier Railway, with her choice/option.

6. However, there shall be no order as to costs.

7. Parties are directed to act on the basis of the server copy of this order.
