A free fight between the two groups of people concerning some marriage ceremony has resulted into sufferance of serious injuries to the persons belonging to both the groups and filing of police cases by both of those groups. The petitioners are members of one group against whom allegation is of infliction of grievous injury (as per material available in the case diary at page 27) has been made.

Vis-à-vis the petitioners have also incorporated injury report in the instant application, showing sufferance of injury by members of their groups.

Having found as above and also in view of the fact that investigation has been completed in the present case, I find petitioners' custodial detention may not be necessary any further for the purpose of investigation.

Their bail prayer is allowed.

In the event of arrest, the petitioners shall furnish a bail bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Siliguri. The petitioners shall comply with the condition under Section 482(2) of the 2023 BNSS and shall cooperate with investigation in all possible way. They shall not intimidate witnesses in any manner and shall not tamper with the evidence of the case in any manner whatsoever.
