The charge is under Section 4 of the Protection of Children from Sexual Offences Act, 2012 read with Sections 363/365 of the Indian Penal Code.

We have seen the medical report and the statements of witnesses.

The petitioner says that he has been in custody for 18 months. Charge sheet has been submitted. No useful purpose will be served by keeping the petitioner further in custody.

Having considered the gravity of the offence and the possible extent of complicity of the petitioner in the commission thereof, although charge sheet may have been filed, we are not inclined to allow the petitioner's prayer for bail at this stage.

However, considering the lengthy period of detention of the petitioner we request the learned Trial Court to expedite

the trial to the extent possible and bring the same to its logical conclusion as soon as the business of the court may permit.

Accordingly, the application for bail being CRM 859 of 2021 is dismissed.
