Antara Roy Mr. Avrojyoti Das, Mr. Rajdeep Das ... for the petitioner Mr. Mayank Roy ... for the opposite party The applicant/petitioner in this revisional application has filed an application under Sections 12 and 25 of Guardians and Wards Act, 1890 read with Section 6 of the Hindu Minority and Guardianship Act, 1956 before the learned District Judge at Darjeeling on 27th February, 2025. The mediation has failed. The opposite party has also filed her written objection on 27th March, 2025.

The principal grievance of the applicant/petitioner is that the matter had been adjourned on 21st April, 2025 on the ground that the learned District Judge, Darjeeling was unavailable and the charged Court being the Court of learned Additional District Judge, 2nd Court, Darjeeling did not take up the matter. The matter was once again adjourned and has been lastly adjourned on 8th May, 2025 on the ground

that the learned District Judge, Darjeeling was away for holding Circuit Court at Siliguri and the charged Court being the Court of learned Additional District Judge, 2nd Court, Darjeeling did not take up the matter. The opposite party is represented.

The applicant/petitioner says that a direction be given for hearing out the said application as expeditiously as possible. The opposite party does not object to such prayer.

In the aforesaid facts and circumstances, the learned District Judge at Darjeeling or the Court incharge is directed to dispose of the said application filed by the applicant/petitioner as expeditiously as possible but, not later than four months from the date of communication of this order. The applicant/petitioner shall be entitled to apply before the Court of learned District Judge at Darjeeling or before the Court incharge for preponing the next date which is fixed on 19th July, 2025.

Nothing further remains to be adjudicated in this revisional application. The same is accordingly, disposed of.
