1. The petitioner herein prays for bail apprehending arrest in connection with Criminal Misc. Case No. 373 of 2026 arising out of Kotwali Police Station Case No. 54 of 2026 dated 05.02.2026 under Sections 108/3(5) of BNS, 2023 pending before the Learned Sessions Judge, Jalpaiguri.
2. On hearing the learned counsel for the petitioner and learned counsel for the State who has placed the case diary, the materials herein show that the parties herein were in a romantic relationship which led to a proposal for marriage
but subsequently due to an issue relating to demand of dowry as a precondition to marriage led to the (prima facie) suicide of the victim.
3. Considering the said facts, this Court grants anticipatory bail to the petitioner herein.
4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 10.000/- with two sureties of Rs. 5,000/- each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate witnesses. The petitioner shall meet the I. O. once a week until further order. The petitioner shall not leave the jurisdiction of the trial court without prior leave of the trial court.
5. CRM (A) 380 of 2026 is, thus, disposed of.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
