The grievance of the petitioner is that the father of the petitioner was the owner of the property measuring an area of 0.060 acres situated at Mouza Marizbari being patta no. 18102, JL No. 021 under the jurisdiction of Kotwali Police Station, District - Cooch Behar and the land was acquired by the National Highway Authority of India.

The land acquisition officer had issued the

notice for acquisition of the land of the petitioner in the year 2011 and, subsequently, several correspondences were made but in the meantime the father of the petitioner expired and lastly on 30th June, 2022 again the notice was issued wherein the name of the father of the petitioner is appearing as serial no. 8.

Counsel for the petitioner submits that till date the petitioner has not received any compensation with respect to the acquired land by the Government and, accordingly, lastly on 5th April, 2023 the petitioner has made a representation to the Special Land Acquisition Officer but the said representation has not yet been considered.

In view of the submission made by the Counsel for the petitioner, this Court finds that no purpose would be served by keeping the writ petition pending. Accordingly, WPA 1145 of 2023 is disposed of by directing the respondent no. 6, i.e. the Special Land Acquisition Collector, Cooch Behar to

consider the representation of the petitioner by giving an opportunity of personal hearing to the petitioner and to pass a reasoned and speaking order within a period of six weeks from the date of communication of this order.

WPA No. 1145/2023 is thus disposed of.
