Being aggrieved by the order dated 30.3.2023, petitioner has preferred this application seeking temporary stay against the order of issuance of warrant in respect of the present petitioner, namely, Darpan Subba for a limited period so that the petitioner may appear before the court below. Since the prayer made by the petitioner is innocuous and if an order is passed in terms of the prayer made on behalf of the petitioner, the opposite party will have no cause to prejudice, the service of copy of the application as well as notice upon the opposite party is dispensed with. Considering the submissions made on behalf of the petitioner, he is directed to surrender/appear before the court below within the next date, i.e., on 17.5.2023. The order regarding issuance of warrant of arrest against the present petitioner, Darpan Subba is stayed till 17.5.2023. If the petitioner fails to appear before the court below by the date fixed, the order impugned will survive on and from 17.5.2023.

Accordingly, CRR 114 of 2023 is disposed of.
