AD-5 Ct No.01 Jalpaiguri 20.05.2025 sp Calcutta High Court In the Circuit Bench at Jalpaiguri Appellate Side CRM (A) 322 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

And In the matter of: Jagabandhu Sarkar & Anr.

.... Petitioners.

Mr. Hillol Saha POdder.

..for the petitioners.

Mr. Saikat Chatterjee, Mr. Chattu Roy.

..for the State.

1. The application for anticipatory bail is not pressed against the petitioner/applicant no. 1 and shall stand dismissed as not pressed.

2. The petitioner/applicant no. 2 Renubala Sarkar @ Ruchi Sarkar @ Buchi is the sister-in-law of the deceased. The de facto complainant being the sister of the deceased has repeatedly asserted that the in-laws and husband of the deceased have continuously tortured and have beaten her.

3. The victim was thrown out from the house on repeated occasions and unable to bear torture inflicted on her immediately 3 days before the date of occurrence, the victim consumed poison. She was earlier admitted to a medical

hospital and later shifted to Cooch Behar Medical College and Hospital. The in-laws brought her back to the house without completing treatment and readmitted her to the hospital when her condition deteriorated substantially. She died in the hospital as a result of consuming poison. The complaint indicates direct causal connection between torture inflicted by the petitioner and her family members on the victim.

4. Considering the case diary and the evidence collected by the police, this Court is unable to grant anticipatory bail to the petitioner/applicant no. 2, Renubala Sarkar @ Ruchi Sarkar @ Buchi.

5. Hence, CRM (A) 322 of 2025 is, thus, rejected. (Rajasekhar Mantha, J.)
