The petitioner seeks general transfer on medical ground from Maynaguri High School, Cooch Behar to any of the schools near her residence. A representation was made to the Secretary, West Bengal Central School Service Commission wherein the option given by the petitioner has been mentioned as follows:-
1. Tufanganj Ila Debi Girl's High School (HS)
2. Boxirhat Girl's High School (HS)
3. Tufanganj Harirdham High School (HS) It is further submitted that as the Utsa Shree portal had been suspended, the petitioner was not in a position to apply through proper channel. Thus an application was directly made to the West Bengal Central School Service Commission.
Without considering the validity of the contentions of the petitioner and without passing any opinion on the merits of the prayer of the petitioner, the writ petition is
disposed of with a direction upon the Secretary, West Bengal Central School Service Commission to dispose of the representation of the petitioner which is a page 37 of the writ petition, in accordance with law upon granting an opportunity of hearing to the petitioner. The entire exercise shall be completed within a period of four months.
Accordingly, the writ petition is disposed of. However, there will be no order as to costs.
All the parties are directed to act on the basis of the server copy of this order.
