None appears for the private respondent despite service.

Heard learned counsels for the parties.

The petitioner's grievance is that certificate under Section 8 of the Payment of Gratuity Act, 1972 was issued to the Certificate Officer, Darjeeling for realisation of a sum of Rs.79,206/- as gratuity along with interest and the same is pending before the Authority since 26th November, 2015.

The innocuous prayer of the petitioner is for expeditious disposal of the certificate case.

Learned counsel for the State respondents submits that the third respondent may be directed to dispose of the case within a stipulated time frame. In view of the above, the writ petition is disposed of directing the third respondent to consider and dispose of the certificate case pending before him since 26th November, 2015 within two months from the date of communication of this order after affording reasonable opportunity of hearing to all the stake holders including the petitioner and the private respondent, in accordance with law..

The decision taken by the Authority shall be communicated to the petitioner within a week thereof. W.P.A. 1472 of 2022 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
