Learned advocate appearing for the petitioner submits that the petitioner was arrested on 02.06.2024 and since then, he is in custody. However, although charge-sheet has been submitted, but, according to the petitioner, till date, charge has not been framed as one of the accused persons has been absconding.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that huge quantity of ganja/contraband was seized from the possession of the petitioner and State could not take any steps as one of the accused person is absconding. Having considered the fact that charge-sheet has already been submitted, the quantity of contraband seized

and the fact that the court is unable to proceed because of one of the accused fleeing away from the process of law, I am of the opinion that although the petitioner cannot be released on bail at this stage, but the learned Trial Court should take steps for exhausting all the process of law, split up the trial of the case and take steps so that within sixty days from the next date so fixed steps be taken for overcoming the stage of consideration of charges. Petitioner would be at liberty to approach this Court after the stage of consideration of charges is over. As such, the prayer for bail of the petitioner at this stage is rejected.

The application for bail, being CRM (NDPS) 219 of 2025, is, thus, dismissed.
