The petitioner claims that she was not given the benefit of ROPA 2019. The petitioner retired from service on December 31, 2019 and it is contended that the pensionary benefits and gratuity were issued as per ROPA 2009. Accordingly, the petitioner made a representation before the authorities.

The District Inspector of Schools, Primary Education, Alipurduar shall dispose of the representation of the petitioner which is Annexure-P/3 at Pages 29 and 30 of the writ petition, in accordance with law. If necessary, the concerned school authorities from where the petitioner retired and the petitioner, shall be granted an opportunity of hearing. A reasoned order shall be passed and communicated.

The entire exercise shall be completed within a period of four months from the date of communication of this order.

Accordingly, the writ petition is disposed of. Parties are directed to act on the basis of the server copy of this order.
