Item No.25 13.06.2024 Court. No. 2 GB CALCUTTA HIGH COURT

IN THE CIRCUIT BENCH AT JALPAIGURI

APPELLATE JURISDICTION WPA 1096 of 2024 Smt. Suprova Pal VS Union of India & Ors.

Mr. Subhankar Dutta ... for the Petitioner.

Mr. Sudipto Majumdar, Mr. Tridip Saha, Mr. Sourab Kar ... for the State.

Affidavit-of-service filed in Court today, be kept with the record.

The Court does not need to interfere with the transfer order of the petitioner. However, as it is the contention of the petitioner that her child is due to undergo an operation at Siliguri, an extension of time to join the transferred post is allowed only on humanitarian grounds. The petitioner is required to join the transferred post within October 1, 2024. The petitioner will continue to discharge her duties at GC, CRPF, Siliguri, PO. Sushruta Nagar, District - Darjeeling, Pin - 734012.

This order is being passed only on a sympathetic consideration and as an equitable relief. Considering the fact that the petitioner's husband is at a hardship posting at Kashmir and she has to manage her two minor children one of whom is suffering from various ailments, time is allowed

till October 1, 2024. In case the petitioner fails to join within October 1, 2024, the employer may take necessary steps as per the service rules.

Accordingly, the writ petition is disposed of. However there will be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
