This revisional application was preferred challenging the proceedings of Mathabhanga Police Station Case No. 390 of 2018 dated 21.12.2018 including the charge-sheet submitted in connection with the said case.

On the earlier occasion also none appeared on behalf of the petitioners. Accordingly, Mr. Luksom, learned advocate for the State was directed to produce the case diary. On perusal of the statement of the victim recorded under Section 164 of the Code of Criminal Procedure, I find that there are offences under Sections 376 and 417 of the Indian Penal Code. There are also allegations of assault and charge-sheet has been filed under the respective Sections of 342, 323, 506 of the Indian Penal Code read with Section 34 of the Indian Penal Code. Having regard to the statement of the victim, I am of the opinion that no interference can be made at this stage without the case proceeding to the trial. Accordingly, the revisional application being CRR 134 of 2022 is dismissed.

All pending connected applications, if any, are consequently disposed of.
