13.06.2023 SL No.10 Court No.1 (gc) (Rejected) Circuit Bench of Calcutta High Court At Jalpaiguri CRM (A) 354 of 2023 In Re:- An application for anticipatory bail under section 438 of the Code of Criminal Procedure filed in connection with Naxalbari Police Station Case No.85 of 2023, dated 20.04.2023 under Sections 498A/304B/302 of the Indian Penal Code. And In the matter of : Abhimunya Ghosh & Anr.
- Petitioners.
Mr. Sayan De, Mr. Manash Dutta Chowdhury, Mr. Sampad Das, Ms. Esha Acharya, ... For the Petitioners.
Mr. Aditi Shankar Chakraborty, Ld. A.P.P., Mr. Aniruddha Biswas, ... For the State.
The learned Counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated. The learned Counsel for the State, however, opposes the prayer for anticipatory bail.
Considering the materials available in the case diary and the medical report incriminating the petitioners in the commission of alleged offence, we are not inclined to grant anticipatory bail to the petitioners at this stage.
Accordingly, the application for anticipatory bail stands rejected and disposed of.
All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Raja Basu Chowdhury, J.) (Soumen Sen, J.)
