This is an application for relaxation/modification of condition of bail.
Learned counsel for the petitioner submits that the accused petitioner is a day labourer. He could not furnish the bond amount as directed by this Court vide order dated 10th June, 2025. He prayed for relaxation of bond amount.
Learned counsel appearing on behalf of the State raised strong objection.
Considering the submission of the learned counsel for the petitioner and also considering the fact that an order of bail has to be complied with in its true letter and spirit but at the same time
when an order of bail was granted in favour of an individual, such order of bail has to be on such a condition so that the person may comply with the same.
The petitioner has successfully demonstrated before this Court. He is unable to furnish the bond amount as reflected in the order dated 10.06.2025. Consequently, the order of bail regarding furnishing bond amount is hereby modified from Rs.50,000/- to Rs.20,000/-.
I make it clear that the petitioners have to furnish a bond of Rs.10,000/- (Rupees Ten Thousand) by a registered surety and Rs.10,000/- (Rupees Ten Thousand) by one local surety. The furnishing of bond as directed hereinabove is subject to the satisfaction of learned Special Court (NDPS), Jalpaiguri. Under the above observations, the application for modification of bail is considered and allowed.
