Mr. Nilay Chakraborty ...... for the State Heard the learned advocates appearing for the parties. We have considered the materials on record. Statements of witnesses and contemporaneous document namely, seizure list show recovery of narcotic substances i.e. 40 number of 2 ml Lupigesc injection IP, 70 numbers of 2 ml. Diazepam Injection IP and 60 numbers of 2ml. Phenergan Injection IP containing narcotic substance above commercial quantity from the petitioner. In view of the aforesaid fact and in the light of the statutory restrictions under Section 37 of the N.D.P.S. Act, we are not inclined to grant bail to the petitioner.
