Learned advocate appearing for the petitioner submits that the petitioner is the mother-in-law of the deceased who has been implicated in connection with the instant case. Additionally it has been submitted that the main thrust of accusations are against the husband who has been arrested and is detained in custody. So far as the mother-in-law is concerned, there is omnibus allegation and as such, she may be favoured with an order of anticipatory bail Learned advocate appearing for the State has produced the case diary and drawn the attention of the Court to the medical documents along with the statement of the witnesses as well as the FIR. It has also been submitted that the investigation of the case has been concluded.
Having regard to the present stage of the case and the complicity of the petitioner, I am of the view that the custodial detention of the petitioner is unwarranted. As such, the prayer for anticipatory bail of the petitioner is allowed.
In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
This order of anticipatory bail will remain in force for a period of six weeks from the date of this order. The application for anticipatory bail, being CRM(A) 334 of 2025, is, thus, disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
