Learned advocate appearing for the petitioners submit that there are case and counter case inter se the parties, while the petitioners have been arraigned in connection with the Dinhata Women Police Station case no. 34 of 2025 dated 19.04.2025. On the other hand at the instance of the petitioner no.1 Dinhata Police Station case no. 197/2025 has been registered for investigation. Learned advocate also submits that the present petitioners are innocent villagers who have been falsely implicated in connection with the instant case. As such there custodial interrogation may not be warranted.

Consequently they may be favoured with an order of anticipatory bail.

Learned advocate appearing for the State has produced the Case Dairy along with medical report.

I have seen the background of the case which has its genesis in Dinhata Women Police Station case no. 25/25 dated 18.03.2025. The factual foundation of the FIR of the present case is that in connection with P.S. Case no. 25/25 when one of the injured opposed the prayer for bail the same led to the consequential cause of the injury suffered by the two ladies. Having regard to the background of the case, I am not inclined to release the petitioner on bail.

Accordingly, CRM (A) 335 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
