Learned counsel appearing on behalf of the petitioners submits as follows. The petitioner no.1 is the nominee of Iodised Salt appointed by the respondent no.1 by a memo no.G/4878/viii-13 dated 06.12.1993. The petitioner no.2 is the son of the petitioner no.1. The storage and supply of iodised salt by the petitioner had initially been allowed from his godown at village Baro Atiabari by Khatian No.223, Dag No.3208, Cooch Behar. The younger brother being the respondent no.3 had given consent initially. Later on, for some time the business could not be run. At present, the petitioners have made a representation before the concerned authority, which has not yet been responded to.
Learned counsel appearing on behalf of the respondent no.3 submits that his client may be heard at the time of consideration of such representation. Learned counsel appearing on behalf of the State submits that if a representation is pending, the same shall be disposed of in accordance with law.
In view of the above, let the petitioners'
representation regarding initiation of storage and supply of iodised salt be considered by the respondent no.1, after hearing the petitioners as well as the respondent no.3, in accordance with law and as expeditiously as possible, preferably within a period of six weeks from the date of communication of this order. Within a week thereafter, the outcome of such consideration shall be communicated to the petitioners.
With these observations, the writ petition is disposed of.
