Learned advocate appearing for the petitioner is directed to serve copy of this revisional application upon Mr. Abhijit Sarkar, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

The petitioner has approached this Court challenging the proceedings of Falakata P.S. Case No. 60 of 2022 dated 02.02.2022 wherein the investigating agency on conclusion of investigation has submitted charge-sheet under Sections 406/409/465/468/471/420 of the IPC. Learned advocate for the petitioner submits that the materials so collected by the investigating agency hardly make out a case thereby calling for the petitioner to face the ordeal of trial. On the other hand, learned advocate for the State submits that the subject-matter of the case relates to Uttarbanga Kshetriya Gramin Bank Jalpaiguri, Falakata Branch.

I have considered the report under Section 173 of the Code of Criminal Procedure. However, the prosecution papers particularly the documents under Section 207 of the Code of Criminal Procedure on which the prosecution intends to rely to prove its case are not available with the petitioner presently.

Having considered the same and the stage of the case, I am of the view that the petitioner would first prefer an application before the learned trial Court at the stage of consideration of charges in respect of the factual aspects which have been canvassed in the present revisional application and thereafter, if so advised, would approach this Court.

With the aforesaid observations, the revisional application being CRR 243 of 2025 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
