The appellants are not represented, nor any accommodation is sought for on behalf of the appellants. The matter last appeared on 13-12when the appellants were also not represented.

The appeal is arising out of an order dated 25-08-2021 in Title Suit No.102/2021, whereby the learned Civil Judge, Senior Division refused to pass ex-parte order of injunction.

We feel that the application for injunction needs to be decided at the earliest.

In view thereof, we dispose of this application by requesting the learned Civil Judge, Senior Division, Jalpaiguri to dispose of the injunction application in Title Suit No. 102/2021, filed by the appellants as early as possible, preferably within a period of eight weeks from the date of communication of this order without granting any unnecessary adjournments to either of the parties unless it is unavoidable.

Both the appeal and the connected application are disposed of.

Registry is directed to communicate this order to the learned Civil Judge, Senior Division, Jalpaiguri.

Parties shall act on the server copy of this order duly downloaded from the official website of this Court.
