Service upon the respondent no.6 has been effected but not on the respondent nos.7 and 8. However, the writ petition is not required to be kept pending, as no mandatory directions are passed.
The petitioner filed a writ petition earlier with an allegation that the Ministry of External Affairs had not taken proper steps with regard to the complaint filed by the petitioner regarding dual citizenship of the respondent nos.6 to 8. The writ petition was disposed of with a direction upon the Secretary, Ministry of External Affairs, South Block, New Delhi to look into the complaint and cause enquiries.
The petitioner's learned advocate has since received a letter from the Ministry of Home Affairs, which
indicates that the District Magistrate, Darjeeling, Bureau of Immigration and FRRO had been requested to make a suitable enquiry and furnish a report before the ministry. It is contended that the report has not yet reached the ministry.
The learned advocate for the State respondents submits that the State authority shall comply with the request of the Ministry of Home Affairs and necessary report will be supplied shortly, upon completion of enquiry.
Under such circumstances, the writ petition is disposed of with a direction upon the State authorities to complete the process of enquiry within a period of two months from the date of communication of this order and take necessary steps as requested by the Ministry of Home Affairs.
Accordingly, the writ petition is disposed of. However, there will be no order as to costs.
All the parties are directed to act on the basis of the server copy of this order.
