16.06.2025 Serial no. 3 [G.S.D] CALCUTTA HIGH COURT
IN THE CIRCUIT BENCH AT JALPAIGURI
CRM (M) 102 of 2025 In re : An Application for Bail under Section 483 of the BNSS, 2023 in connection with Sessions (POCSO) Case No. 32 of 2025 arising out of Maynaguri P.S. Case No. 147 of 2025 dated 16.03.2025 under Sections 329(4)/351(2) of the BNS, 2023 read with Sections 6 of the POCSO Act, 2012.
-AndIn the matter of : Arpit Roy @ Akash Roy ... Petitioner(s) Mr. Sourav Ganguly Mr. Bibek Tarafder Mr. Gopal Roy Ms. Rishita Chakraborty Mr. Bibhash Kr. Nandi ... for the petitioner(s) Mr. A. S. Chakraborty Mr. Sagnik Shankar Sikdar ... for the State Report so submitted by the State be kept with the record.
Learned advocate for the petitioner submits that the petitioner is innocent of the charges and has been falsely implicated in connection with the instant case. Learned advocate further submits that call detail records would reflect that the petitioner was not available at the place of occurrence and inspite of the same, the victim has falsely
implicated the present petitioner who is in custody since 16.03.2025.
Learned advocate for the State has produced the Case Diary, I have considered the statement of the victim under Section 164 of the Cr.P.C. as well as the medical examination report of the victim.
Considering the materials which are appearing against the present petitioner as also the fact that chargesheet has been submitted, I am of the view that this is not a fit case for enlarging the petitioner on bail. Accordingly the prayer for bail of the petitioner is Rejected.
Accordingly, CRM(M) 102 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
