1. The petitioner is the accused person in connection with Samuktala P.S. Case No. 195/2026 dated 27.05.2026 under Sections 314/318(4)/61(2)/3(5) of the Bharatiya Nagarik Suraksha Sanhita, pending before the learned Chief Judicial Magistrate, Alipurduar.

2. The petitioner has not approached the learned trial court before coming directly to this court with his prayer for anticipatory bail.

3. This is in contravention of this Court's earlier order dated 30.06.2026 in CRM (A) 378 of 2026.

4. Hence, let the petitioner be granted liberty to withdraw this application and file afresh before the learned trial court.

5. Let it be directed that till the time the learned trial court hears and disposes of the application for anticipatory bail of the petitioner, there shall be no coercive step taken against him. (Rai Chattopadhyay, J.)
