The petitioner challenges the summoning order passed in connection with C.R. No. 13 of 2019. Records reflect that the summons was issued on or about 14.06.2019 and subsequently, warrant was also issued on 19.02.2020. For more than five years, the warrant of arrest could not be executed.

Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges. Be that as it may, since the warrant of arrest has been issued by a court after application of its mind, it would be the duty of a citizen to appear before the court and thereafter raise plea in respect of the maintainability of the complaint and/or the further proceedings.

As such, the petitioner is granted a last chance for appearing before the learned Judicial Magistrate, Darjeeling. The execution return of the warrant of arrest is kept in abeyance for a period of four weeks, i.e., till 10th July, 2025. In case, the petitioner appears, the learned Magistrate would leniently consider his application for bail and thereafter, if any application for exemption of personal appearance or

dispensation of personal appearance is prayed for, the same be considered in accordance with law. Petitioner would be at liberty to subsequently approach before this Court with prayers challenging the complaint case being C.R. No.13 of 2019 which is pending before the learned Judicial Magistrate, Darjeeling.

With the aforesaid observations, the revisional application being CRR 246 of 2025 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
