13.06.2023 SL No.23 Court No.1 (gc) (Rejected) Circuit Bench of Calcutta High Court At Jalpaiguri CRM (A) 372 of 2023 In Re:- An application for anticipatory bail under section 438 of the Code of Criminal Procedure filed in connection with Dinhata Police Station Case No.12 of 2023, dated 12.01.2023 under Sections 341/324/326/307/506/34 of the Indian Penal Code. And In the matter of : Pushnath Das @ Mutku Das - Petitioner.
Mr. Hillol Saha Podder ... For the Petitioner.
Mr. Ujjwal Luksom, Ms. Namrata Das ... For the State.
The learned Counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated. The learned Counsel for the State, however, opposes the prayer for anticipatory bail.
Considering the materials available in the case diary incriminating the petitioner in the commission of alleged offence, we are not inclined to grant anticipatory bail to the petitioner at this stage.
Accordingly, the application for anticipatory bail stands rejected and disposed of.
