...For the petitioner Mr. Arun Kumar Sarkar, Mr. Sourav Ganguly. ....For the State The petitioner seeks bail on the ground that he is in custody for about 51 days. The petitioner was originally remanded to the police custody for about eight days and subsequently sent to judicial custody.

This Court has carefully considered the entire case diary and has heard the Counsel for the petitioner and the Public Prosecutor. Charge under Sections 302 read with Section 120B of the Indian Penal Code has been framed in this case by the Court below.

Considering the statements of the witnesses recorded under Sections 161 and 164 of the Code of Criminal Procedure and having regard to the post mortem report, this Court is of the view that the prayer for bail should be rejected at this stage.

However, it is ordered that the investigation of the instant case may be expedited by the prosecution. C.R.M. (DB) No. 213 of 2022 is, thus, disposed of.
