The grievance of the writ petitioner is primarily directed against the non-consideration of the representation made to the State respondents. Briefly, the writ petitioner is aggrieved with the selection result pertaining to the engagement of Asha Karmee in Haldibari Block under DistrictCooch Behar. It is submitted on behalf of the petitioner that in respect of selection process there have been serious violations and the successful candidate is not a resident of the concerned Gram Panchyat.

On behalf of the State respondents it is submitted that all the norms of the selection process have been duly followed and there has also been an Enquiry Report prepared based on the

enquiry conducted in respect of allegations made by the petitioner.

It is further submitted that on the basis of the Enquiry Report, it was revealed that there is no substance in the allegations made by the petitioner against the private respondent in respect of the said Gram Panchyat.

Be that as it may, the representation dated 16th January, 2023 (being Annexure P-3 at page-25 of the writ petition) has admittedly not been considered by the State respondents.

In such circumstances, WPA/1201/2023 stands disposed of by directing the State respondents to consider the representation dated 16th January, 2023 made by the petitioner within a period of eight weeks from the date of communication of this order and after hearing both parties.

It is made clear that there has been no adjudication on the merits of the dispute and the respondent no.4 is at liberty to dispose of the representation in accordance with law without being influenced by any observation on the merits made herein.
