Learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case on the basis of statement of the coaccused and as there has been no recovery from the possession of the petitioner he may be favoured with an order of anticipatory bail.

State has produced the Case Diary and a document which reflects that the vehicle/scooty which was seized in connection with the case along with the contraband contained an authorization in the form of photostat copy of notarized document which reflects the name of the present petitioner

being authorized to ply the vehicle. As commercial quantities of codeine phosphate were recovered from the said vehicle and since the investigation is continuing, the custodial interrogation of the present petitioner is warranted for the sake of the case.

Having considered the materials available in the Case Diary as well as the fact that the investigation is in progress, I am not inclined to grant anticipatory bail to the petitioner. Consequently, CRM(A) 346 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
