Learned advocate appearing for the petitioners submits that there is a case and a counter-case between the parties and a long standing land dispute is existing. Additionally, it has been submitted that there was a free fight, consequent to which the petitioners also sustained injuries. However, the police authorities have acted in a biased manner and proceeded with the case against the petitioners.

Learned advocate appearing for the State has opposed the prayer for anticipatory bail and produced the case diary.

I have considered the medical reports and I am surprised to find that the nature of injuries are not simple, yet the doctors have referred to those as simple injuries, although there are lacerated wound at the scalp and dorsum of the hand of all the three injured. Having considered the nature of injuries and the nature of weapon (rod) used, I am of the view that the prayer for anticipatory bail of the petitioner cannot be accepted. As such, the prayer for anticipatory bail of the petitioners is rejected. The application for anticipatory bail, being CRM(A) 347 of 2025, is, thus, dismissed.
