Counsel for the State Mr. Rahman submits that the enquiry into the complaint has commenced under PPGDE No. 653 dated 28th August, 2021. Notices under Section 91 of Cr.P.C. have been issued and the matter is being investigated into.

This court notes that no FIR has been registered till date.

It is, therefore, ordered that strangely a formal FIR be registered in connection with the investigation already done and the same may be concluded in accordance with law within a period of two months from date. Let the final report be filed before the jurisdictional magistrate immediately thereafter.

The Panighata PP under Mirik Police Station shall furnish a copy of such final report to the writ petitioner.

A copy of the report dated 22nd September, 2021 be kept on record.

The writ application is thus disposed of.
